การเป็นผู้ประกอบการที่ดีไม่เพียงมุ่งมั่นในการสร้างผลกำไรเพื่อสร้างความมั่นคงให้กับธุรกิจ ตนเองและพนักงานเท่านั้นยังต้องคำนึงถึงความรับผิดชอบต่อส่วนรวมคือการทำบัญชีและเสียภาษีอย่างถูกต้องตามกฎหมายกำหนดด้วย เพื่อสร้างความน่าเชื่อถือและเป็นการแสดงตนว่าทำธุรกิจด้วยความโปร่งใส ซึ่งทุกวันนี้จะพบว่ามีผู้ประกอบการหลายคนตั้งใจหลีกเลี่ยงการเสียภาษีเพราะคิดว่าเป็นภาระที่ไม่จำเป็นต้องจ่าย ทั้งที่จริงแล้วเรื่องนี้มีความสำคัญมากเพราะสะท้อนให้เห็นถึงความรับผิดชอบของผู้ประกอบการ ดังนั้นหากต้องการเป็นผู้ประกอบการที่ดีแล้วต้องทำความเข้าใจเกี่ยวกับเรื่องภาษีให้ครบรอบด้าน อย่างวันนี้เราชวนมาทำความเข้าใจเกี่ยวกับภาษีซื้อหรือภาษีที่ต้องแสดงรายการเมื่อจะไปยื่นภาษีตามกฎหมายกำหนดและมาทำความเข้าใจเกี่ยวกับ “ภาษีซื้อ”

โดยมีรายละเอียด ดังนี้

1. ภาษีซื้อ คืออะไร

สำหรับคนที่สงสัยว่า ภาษีซื้อ คืออะไรให้ลองคิดตามง่ายๆ ว่า เป็นภาษีที่เจ้าของธุรกิจหรือผู้ประกอบการจะต้องจ่ายเมื่อมีการซื้อสินหรือบริการต่างๆ เพื่อมาทำการค้า ที่ใช้ในการดำเนินกิจการ หลังจากจ่ายแล้วผู้ประกอบการจะต้องเสียภาษีมูลค่าเพิ่มด้วย 7% ทั้งนี้จะต้องรู้หลักเกณฑ์ในการเฉลี่ยภาษีซื้อด้วยเพราะในกรณีที่ผู้ประกอบการที่มีรายได้ไม่เข้าข่ายต้องเสียภาษีมูลค่าเพิ่ม  ไม่สามารถจะแยกได้ว่าภาษีซื้อนั้นเกิดจากการกิจการประเภทใด กรณีนี้จะต้องมีการนำมาเฉลี่ยภาษีซื้อตามส่วนของรายได้ของธุรกิจนั้น ๆ

2. สิ่งที่ต้องรู้เกี่ยวกับ ภาษีซื้อ

ภาษีซื้อ แตกต่างจากภาษีขายอย่างสิ้นเชิง ซึ่งเมื่อผู้ประกอบการทำรายงานภาษีซื้อแล้วพบว่า ภาษีซื้อมากกว่าภาษีขาย ในข้อนี้ผู้ประกอบการสามารถที่จะขอคืนภาษีได้เป็นเงินหรือนำส่วนเกินนี้ไปใช้เป็นเครดิตในการเสียภาษีครั้งต่อไป ไม่เพียงเรื่องนี้เท่านั้นที่ผู้ประกอบการจะต้องรู้ ยังมีเรื่องต้องรู้อื่นๆ อีกด้วย มาดูกันว่าเรื่องไหนบ้างที่ผู้ประกอบการต้องทำความเข้าใจเกี่ยวกับภาษีซื้อ

2.1 หากเริ่มทำกิจการแล้วเป็นระยะเวลาตั้งแต่ 6 เดือนขึ้นไป แต่ยังไม่มีรายได้ สามารถเฉลี่ยภาษีซื้อได้ตามส่วนของประมาณการรายได้

2.2 ต้องทำความเข้าใจว่า ภาษีซื้อ มี 2 ประเภท แต่ละประเภทมีความหมายและข้อบังคับต่างกันดังนี้

2.2.1 ภาษีซื้อ ที่กฎหมายให้นำมาหักออกจากภาษีขายหรือ ที่เรียกง่ายๆ คือสามารถขอคืนภาษีซื้อได้สำหรับภาษีประเภทนี้เกิดจากการซื้อสินค้าหรือบริการจากผู้ประกอบการรายอื่นที่สามารถออกใบกำกับภาษี ใบเสร็จรับเงิน ซึ่งผู้ประกอบรายอื่นนั้นต้องมีการจดภาษีมูลค่าเพิ่ม (ภ.พ.20) กับกรมสรรพากรอย่างถูกต้องตามกฎหมายกำหนด

2.2.2 ภาษีซื้อต้องห้าม หรือ ภาษีซื้อ ที่ตามกฎหมายไม่ให้นำมาหักออกจากภาษีขาย ซึ่งมีรายละเอียดที่ผู้ประกอบการต้องทำความเข้าใจว่าหมายถึงอะไรบ้าง มีลักษณะอย่างไรเพื่อที่จะไม่ต้องนำมาทำรายงานภาษีซื้อให้เสียเวลา

3. ภาษีซื้อต้องห้าม คืออะไร ทำไมผู้ประกอบการต้องรู้ก่อนจะยื่นภาษี

ลักษณะของ ภาษีซื้อต้องห้าม จะไม่มีใบกำกับภาษีหรือไม่อาจแสดงใบกำกับภาษีได้ สืบเนื่องมาจากเวลาไปซื้อสินค้าหรือบริการจากผู้ประกอบการรายอื่น ผู้ประกอบการรายนั้นไม่ได้ออกใบกำกับภาษีหรือมีการออกแต่ระบุเป็นชื่อบุคคลอื่น นอกจากนั้นยังภาษีซื้อต้องห้ามยังรวมถึงกรณีที่ใบกำกับภาษีมีข้อความที่ไม่ถูกต้องหรือไม่สมบูรณ์ ดังนั้นการทำรายงานภาษีซื้อจึงจะต้องทำอย่างเต็มรูปแบบ ครบถ้วนตามกฎหมายและอีกหนึ่งลักษณะที่จัดว่าเป็นภาษีซื้อต้องห้ามคือเป็นภาษีที่ไม่เกี่ยวข้องกับการประกอบกิจการโดยตรงแม้ว่าในการซื้อสิ่งนั้นจะได้ใบกำกับภาษีก็ตาม หากแบ่งเป็นข้อ ๆ เกี่ยวกับลักษณะของภาษีซื้อต้องห้าม เพื่อให้เข้าใจง่ายยิ่งขึ้น ได้แก่

1. ไม่มีใบกำกับภาษีหรือไม่สามารถแสดงใบกำกับภาษีได้

ข้อความในใบกำกับภาษีไม่ถูกต้อง สาระสำคัญขาดหายไปคือไม่มีข้อความตามมาตรา 86/4 แห่งประมวลรัษฎากร

1. ภาษีซื้อ ที่ไม่ได้เกี่ยวข้องกับการประกอบกิจการของผู้ประกอบการที่แม้จะจดทะเบียนภาษีมูลค่าเพิ่ม แล้วก็ตาม

2. ภาษีที่เกิดจากรายจ่ายเพื่อรับรอง เช่น ค่าอาหาร ค่าเครื่องดื่ม ค่าที่พักและอื่นๆ ที่จัดว่าเป็นรายจ่ายเพื่อประโยชน์ของคนใดคนหนึ่ง

3. ภาษีซื้อที่ออกโดยผู้ไม่มีสิทธิ์ออกใบกำกับภาษี เช่น เป็นบุคคลที่ไม่ใช่ผู้ประกอบการที่จดทะเบียนภาษีมูลค่าเพิ่ม หรือแม้จะเป็นผู้ประกอบการที่จดทะเบียนภาษีมูลค่าเพิ่มแล้วแต่อยู่ต่างประเทศก็จะนับว่าเป็นภาษีซื้อต้องห้าม

4. ภาษีซื้อที่เกิดจากการซื้อ เช่าซื้อ หรือโอนรถยนต์ รถยนต์โดยสารที่นั่งไม่เกิน 10 คนหรือรถที่ใช้นั่งเป็นปกติในชีวิตประจำวัน

ภาษีที่เกิดจากการก่อสร้างอาคารหรืออสังหาริมทรัพย์

  1. ภาษีซื้อ ตามใบกำกับภาษีอย่างย่อ

ภาษีซื้อต้องห้าม ยังมีรายละเอียดอีกปลีกย่อยอีกจำนวนมากดังนั้นผู้ประกอบการจะต้องดูรายละเอียดให้มั่นใจก่อนเพื่อที่จะไม่ต้องนำภาษีซื้อต้องห้ามไปใช้ในการทำรายงานภาษีซื้อเพราะหากนำมาใช้เป็นภาษีซื้อ หากโดนตรวจสอบจากกรมสรรพากรผู้ประกอบการจะโดนเรียกเก็บค่าปรับเป็นเบี้ยปรับที่เกิดจากการนำภาษีซื้อต้องห้ามมาใช้ ซึ่งค่าปรับในส่วนนี้จะมี 2 กรณี

  1. เบื้อปรับ 1 เท่าของจำนวนภาษีตามใบกำกับภาษี ในส่วนนี้หากผู้ประกอบการยื่นภาษีซื้อต้องห้ามที่ไม่อาจจะแสดงใบกำกับภาษีได้ รวมถึงใบกำกับภาษีที่ไม่สมบูรณ์ รวมถึงภาษีที่ไม่เกี่ยวข้องโดยตรงกับการประกอบการกิจการ
  2. เบี้ยปรับ 2 เท่าของจำนวนภาษีตามใบกำกับภาษี ในส่วนนี้หากผู้ประกอบการยื่นภาษีปลอมหรือจัดทำใบกำกับภาษีปลอมจะถูกเรียกเก็บค่าปรับ

ทั้งนี้ค่าปรับจะเรียกเก็บในจำนวนที่ไม่เท่ากันขึ้นอยู่กับว่าผู้ประกอบการนำส่งภาษีช้าเป็นเวลากี่วัน เช่น ชำระภาษีมูลค่าเพิ่มภายหลัง 15 วันจะต้องเสียเบี้ยปรับร้อยละ 2 ของเบี้ยปรับ, ชำระภาษีมูลค่าเพิ่มภายหลัง 15 วันแต่ไม่เกิน 30 วันนับตั้งแต่วันที่พ้นกำหนดจะต้องเสียเบี้ยปรับร้อยละ 5 ของเบี้ยปรับ หากไม่อยากจะเสียค่าปรับในส่วนนี้ผู้ประกอบการจะต้องตรวจสอบให้มั่นใจว่าภาษีซื้อแต่ละรายการถูกต้องตามกฎหมายกำหนดไม่ใช่ ภาษีซื้อต้องห้าม เพราะสุดท้ายแล้วนอกจากเสียเวลาในการเก็บรวบรวมรายการภาษี ยังจะโดนเรียกเก็บค่าปรับอีกด้วย ซึ่งแต่ว่าจะเป็นจำนวนเงินไม่มากแต่ก็ต้องยอมรับว่าไม่ควรเกิดขึ้นบ่อยเพราะถือว่าเป็นรายจ่ายไม่จำเป็น การให้ความสำคัญในเรื่องยื่นภาษีจึงถือว่าเป็นส่วนสำคัญในการทำธุรกิจไม่ว่าจะเป็นธุรกิจรายเล็กหรือรายใหญ่ก็ตาม
